Terms and Conditions
Introduction
1. Our prize competition ‘’Lemon-Aid’’ is organized by MyChild’sCancer Inc. of 437 Madison Ave, New York, New York 10022, US (C/O Wiggin and Dana LLP), registered as a non-profit charitable corporation with 501(c)(3) tax-exempt status in the United States. Tax-exempt number: 47-1443808
2. By registering, you are agreeing to be bound by these Terms and Conditions. If you have any questions, please contact info@mychildscancer.org
3. MyChild’sCancer reserves the right to refuse an applicant or to refuse to award the prize to anyone who breaches these Terms and Conditions.
Eligibility
4. Only US residents are eligible to register and participate in the competition. Unless otherwise stated, the competition is open to all US residents.
5. Participants under 18 must get consent from their parent(s) or legal guardian(s) before registering. The parent(s) or legal guardian(s) of participants under 18 years old must agree to these Terms and Conditions on behalf of any minor participant.
6. MyChild'sCancer reserves all rights to disqualify you if, in its sole judgment, your conduct is contrary to the spirit or intention of the competition.
7. MyChild’Cancer reserves the right to hold void, cancel, suspend, or amend the promotion if it becomes necessary to do so.
Start and Closing Dates
8. The competition shall open for registration at the time and on the date specified on our website and/or social media channels, and similarly, shall close to registration at the time and on the date specified on our website and social media channels.
9. Any registration received after the closing of the competition will be invalid and will not be entered into the competition.
10. No responsibility can be accepted for any registration that is not received by MyChild’sCancer for any reason whatsoever.
11. We reserve the right to cancel or amend the competition and these terms and conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of our control. Any changes to the competition will be notified to applicants as soon as possible by us.
Winners & Prizes
12. Competition prizes shall be specified on our website or social media channels.
13. The prize is non-exchangeable and no cash alternative is offered. MyChild’Cancer reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond MyChild’scancer's control makes it necessary to do so.
14. Competition prize winners will be notified of the competition result by email or telephone not more than 15 days following the closing date of the competition, and will receive their prizes not more than 30 days following that closing date.
15. Reasonable efforts will be made to contact the prize winner for 14 days but if the winner fails to respond to our notification attempts within this time or provide an address for delivery of the prize we reserve the right to disqualify that participant and offer the prize to the next eligible participant and thereafter until a winner is found.
16. The results of the competition will be announced on our website, newsletter and social media within 15 days following the closing date of the competition. The announcement may include the name and photograph, the town or state of residence and prize details of each prize winner, and consent is hereby given to use your name and likeness without compensation for this purpose.
Limitation of Liability
17. Insofar as is permitted by law, MyChild’sCancer and its staff will not in any circumstances be responsible or liable to the competition’s participants or accept any liability for any loss, damage, personal injury or death occurring as a result of taking part in the competition, including during the operation of the stands.
18. MyChild’sCancer will not accept responsibility for donations that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.
Data Protection and Publicity
19. MyChild’sCancer is committed to protecting and respecting your privacy and will only use your personal information in accordance with these Terms and Conditions
20. By registering, you agree that any personal information provided by you with your registration may be held and used by MyChild’sCancer or its staff to administer the competition.
21. We may undertake publicity activities relating to the competition and prize awards. The winner hereby agrees to the use of their name, photograph and disclosure of town or state of residence in any post-prize-winning publicity
22. MyChild’sCancer reserves the right to update these Terms and Conditions from time to time and any updated version will be effective as soon as it is published on the website.
